What is this lawsuit about?

Danielle Peterson (the "Named Plaintiff") has filed a lawsuit against Jacob Rieger & Company, LLC dba J. Rieger & Co. ("J. Reiger") alleging violations of the federal Fair Labor Standards Act ("FLSA") by retaining tips and distributing them to managers, supervisors, and non-tipped employees. The Court has not yet made any rulings on the merits of the case.

What is a collective action and who is involved?

In a collective action lawsuit, one or more people sue on behalf of others who have similar claims. The Named Plaintiff seeks to represent current and former employees who were servers, server trainees, bartenders, and/or bartender trainees from June 14, 2020, to the present. J. Reiger is the defendant.

The Court has not yet made a decision on the case. This notice does not suggest that the Plaintiffs will win or lose.

Can I join this lawsuit?

If you were a current or former server, server trainee, bartender, or bartender trainee of Jacob Rieger & Co. from June 14, 2020, to the present, you may join this lawsuit. To join, you must complete the Consent to Join Form by July 13, 2024.

If you choose not to join the lawsuit, you will not be affected by any judgment or settlement and will retain the right to file your own individual lawsuit against J. Reiger separately for the same claims, subject to any defenses that might be asserted. However, the statute of limitations continues to run on any claims you may have.
